These Terms and Conditions (the “Terms”) constitute a legally binding agreement between you, the user of this website, and Nuvirtis, a provider of virtual diagnostic assessments and related services (hereinafter referred to as “Nuvirtis,” “we,” “us,” or “our”). By accessing, using, or engaging with any part of our website (the “Site”), including but not limited to browsing the Site, submitting information, or purchasing services, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations.

If you do not agree to these Terms in their entirety, you are expressly prohibited from using the Site and must cease use immediately. Your continued use of the Site signifies your acceptance of any amendments or updates to these Terms, which Nuvirtis reserves the right to modify at any time at its sole discretion. Any modifications will be effective upon posting on the Site, and it is your responsibility to review these Terms regularly.

Scope of Services:

Nuvirtis specializes in providing comprehensive virtual assessments for Autism Spectrum Disorder (ASD) and Attention Deficit Hyperactivity Disorder (ADHD). We offer assessments for both children and young people aged 7 to 18 years old, as well as for adults aged 18 and above. Our services are conducted entirely through virtual platforms, ensuring accessibility and convenience for our clients.

Our assessments are performed by qualified clinicians who have expertise in the diagnostic evaluation of ASD and ADHD. The assessments involve structured interviews, observation, standardized questionnaires, and, where applicable, the review of previous medical and educational records. Following the assessment, a comprehensive report is provided, which includes diagnostic conclusions and recommendations for further steps.

Intellectual Property Rights

All intellectual property associated with this Site, including but not limited to text, images, logos, icons, graphics, design elements, software, audio, video, downloadable materials, and all other content found on the Site (collectively, the “Content”), is the sole and exclusive property of Nuvirtis or its licensors. Such Content is protected under applicable copyright, trademark, patent, and other intellectual property laws.

Any unauthorized use of the Content, including but not limited to the reproduction, distribution, display, or transmission of the Content in any form, without express written permission from Nuvirtis, is strictly prohibited. User Eligibility

If Nuvirtis believes, in its sole discretion, that you are engaging in any prohibited activities or otherwise violating these Terms, we reserve the right to restrict, suspend, or terminate your access to the Site without notice and may pursue any legal remedies available under applicable law.

Sale of Services

Nuvirtis offers virtual diagnostic assessments for ASD and ADHD, subject to specific terms and conditions associated with each service offering. By purchasing any service from Nuvirtis, you agree to be bound by these Terms, as well as any additional terms presented to you at the time of purchase. Nuvirtis reserves the right to modify the terms of its service offerings at any time, and all services available on the Site at the time you access it will be governed by the terms in effect at that time.

Service Descriptions:

Nuvirtis strives to provide accurate descriptions of the services offered on the Site. However, we do not warrant that service descriptions or any other content on the Site are accurate, complete, reliable, current, or error-free. You agree that your decision to purchase services from Nuvirtis is made at your own risk, and we disclaim all liability for any discrepancies between service descriptions and the actual services provided.

Right to Modify, Reject, or Cancel Orders

Nuvirtis reserves the right to modify, reject, or cancel any order at any time for reasons including but not limited to the unavailability of services, errors in pricing or descriptions, or other unforeseen circumstances. If your order is cancelled and payment has already been processed, you will be entitled to a refund of the amount paid.

Payment and Billing

Nuvirtis offers flexible payment options for our virtual assessments, allowing clients to pay either in full upfront or via a payment installment plan offered through Klarna.

Upfront payment: You may choose to pay the full amount of the assessment fee upfront at the time of booking. Payment will be processed through a secure payment gateway, and by providing your payment information, you warrant that the information provided is accurate and that you have the legal right to use the payment method provided.

Klarna Payment Instalments: Nuvirtis also provides the option to spread the cost of your assessment through Klarna’s installment payment plan. This allows you to split the total assessment fee into three interest-free payments: The first payment is due at the point of purchase.
The remaining two installments will be automatically charged to your payment method every 30 days thereafter.
By selecting Klarna as a payment option, you agree to be bound by Klarna’s terms and conditions which can be found on their website "htpps://klarna.com", which are separate from Nuvirtis’ Terms and Conditions. Any issues regarding your payment installments should be addressed directly with Klarna.

Cancellation policy

When you book an appointment with Nuvirtis, you are reserving the exclusive time of the clinician for your assessment or intervention. As such, cancellations, rescheduling, or failure to attend will be governed by the following:

A minimum of 48 hours' notice is required to cancel or reschedule an appointment. If you fail to provide at least 48 hours’ notice, a cancellation fee equivalent to 25% of the total assessment fee will apply. Cancellations made with less than 24 hours’ notice or failure to attend an appointment will result in a charge of 50% of the total assessment fee.

For appointments scheduled on a Monday, cancellation or rescheduling notice must be given no later than 12:00 p.m. on the preceding Thursday. If you reschedule more than twice, Nuvirtis reserves the right to withdraw the service and terminate the agreement without refund.

Exceptions to the Cancellation Policy

While we recognize that unforeseen circumstances may arise, any requests for waivers or modifications to these cancellation terms will be reviewed on a case-by-case basis at the sole discretion of Nuvirtis. Exceptions may be granted under extraordinary circumstances, supported by appropriate documentation.

Third-Party Goods and Services

The Site may contain links to third-party websites, products, or services that are not owned or controlled by Nuvirtis. Nuvirtis assumes no responsibility for the content, privacy practices, or actions of third-party websites or services. The inclusion of third-party links does not imply endorsement by Nuvirtis, and users are encouraged to perform their own due diligence when engaging with any third-party providers.

Limitation of Liability

To the fullest extent permitted by law, Nuvirtis, its directors, officers, employees, agents, contractors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses arising out of or related to your use of, or inability to use, the Site or services provided by Nuvirtis.

Further, Nuvirtis is not liable for the actions, omissions, or negligence of any third-party service providers affiliated with or accessible through the Site. The services provided by independent contractors, such as medical consultations or other expert services, are beyond Nuvirtis’ scope of control and Nuvirtis expressly disclaims any responsibility for such services.

Indemnity

You agree to indemnify, defend, and hold harmless Nuvirtis, its directors, officers, employees, agents, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from your use of the Site, your breach of these Terms, or your violation of any law or the rights of a third party.

Nuvirtis is committed to protecting your privacy and ensuring the confidentiality of your personal information in accordance with the General Data Protection Regulation (GDPR) and relevant national data protection laws. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent possible, and the remaining provisions shall continue in full force and effect.

Governing Law

These Terms shall be governed by and construed in accordance with Irish Law, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms or your use of the Site shall be resolved exclusively in the courts of Ireland.

Final Acknowledgements

These Terms constitute the entire agreement between you and Nuvirtis regarding your use of the Site and supersede any prior agreements or understandings, whether written or oral, related to the subject matter herein.
